Terms of use

Effective October 7, 2026

These terms are an agreement between you and Restathend LLC (“we”, “us”) for using the Simpatico apps and service. By using Simpatico you agree to them and to our privacy policy. If you don't agree, please don't use Simpatico.

1. Who can use Simpatico

You must be at least 18 years old, or the age of majority where you live, and able to agree to these terms. Simpatico is for personal, non-commercial use.

2. Your account

You sign in with Google or Apple. Keep access to that account and your phone secure; you're responsible for what happens in Simpatico under your account. Tell us at support@simpaticoapp.com if you think someone else is using it.

3. Sharing with your partner

Simpatico links your account with one partner. Everything you connect or add to your shared calendar is visible to them, and what they add is visible to you. Only invite someone you want to share with. Either of you can leave the shared calendar at any time in Settings; what happens to shared content when someone leaves or deletes their account is explained on the Delete your account page.

4. Connected calendars

Only connect calendars you're allowed to share. Simpatico reads connected calendars and never changes them. Your use of Google, Apple and other calendar services is also governed by their own terms. Sync can be delayed, and a provider can change or stop access, so Simpatico should not be your only record of important appointments.

5. Your content

You own what you add to Simpatico. You give us permission to store, process and display it only so we can run Simpatico for you and your partner, as described in the privacy policy. Don't use Simpatico to store or share anything illegal, to harass anyone, or to violate anyone else's rights.

6. Acceptable use

Don't try to access other people's data, disrupt or overload the service, reverse engineer it except where the law allows, or use it to send spam or malware. We may suspend accounts that break these rules.

7. Simpatico Plus

• Simpatico is free to use. Simpatico Plus is an optional in-app purchase sold through the Apple App Store or Google Play. The price, and whether it is a one-time purchase or a subscription, is shown in the store before you buy. A subscription renews automatically until you cancel it in your App Store or Google Play account settings; cancelling stops the next renewal and Plus stays on until the end of the period you paid for.
• When one partner buys Simpatico Plus, it unlocks the Plus features for both people in that shared calendar. If the buyer leaves, Plus goes with them to their next shared calendar; if the other partner leaves, nothing changes. If the buyer deletes their account, the partner who remains keeps Plus.
• To get Plus back on a new phone, use Restore purchases on the Simpatico Plus screen while signed in to the same Apple or Google account you bought it with.
• Refunds are handled by Apple or Google under their policies; we can't issue them directly. Request one through reportaproblem.apple.com or Google Play's order history. If a purchase is refunded, Plus is removed.
• Simpatico Plus gives you a personal licence to use the Plus features for as long as we offer Simpatico. We may improve or change features over time, and we won't remove the core of what Plus unlocks without good reason. Where the law gives you additional rights, those still apply.

8. Apple App Store

If you got Simpatico from the App Store, these terms are between you and Restathend LLC, not Apple. Apple is not responsible for Simpatico or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to Simpatico (including product liability, legal compliance or intellectual-property claims). If Simpatico fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You must also follow the App Store's usage rules.

9. Changes and availability

We're always working on Simpatico, so features may change. We may suspend or stop the service; if we stop it entirely, we will give reasonable notice in the app where we can. You can stop using Simpatico and delete your account at any time.

10. No warranty

Simpatico is provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows. We don't promise it will always be available, error-free, or that every event will sync on time.

11. Limitation of liability

To the fullest extent the law allows, Restathend LLC is not liable for indirect, incidental, special or consequential damages, or for missed appointments or lost data, and our total liability for any claim relating to Simpatico is limited to the greater of the amount you paid us for Simpatico Plus in the previous 12 months or US$50. Some places don't allow these limits, so they may not apply to you.

12. Ending your use

You can delete your account at any time in Settings. We may suspend or close accounts that break these terms or put other users or the service at risk.

13. Governing law

These terms are governed by the laws of the State of Maryland and applicable United States federal law, without regard to conflict-of-laws rules, except where the law where you live requires otherwise.

14. Changes to these terms

If we change these terms, we will update the effective date above, and tell you in the app if the change is significant. Continuing to use Simpatico after a change means you accept the new terms.
